This website is operated by Purliearth. Throughout the site, the terms “we”, “us”, and “our” refer to Purliearth. Purliearth offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms & Conditions (“Terms of Service”, “Terms”). These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms of this agreement, then you may not access the website or use any services.
Any new features or tools added to the current store shall also be subject to these Terms. You can review the most current version of the Terms at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website after any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Article 1 – Definitions
In these Terms, the following definitions apply:
- Cooling-off period: the period during which the consumer may exercise the right of withdrawal.
- Consumer: the natural person not acting in the exercise of a profession or business who enters into a distance contract with the entrepreneur.
- Day: calendar day.
- Long-term transaction: a distance contract relating to a series of products and/or services whose delivery obligation is spread over time.
- Durable data carrier: any tool that enables the consumer or entrepreneur to store information in a way that allows future consultation and unchanged reproduction of the stored information.
- Right of withdrawal: the option for the consumer to withdraw from the distance contract within the cooling-off period.
- Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.
- Distance contract: a contract concluded within the framework of an organized system for remote sales of products and/or services where exclusive use is made of one or more remote communication techniques.
- Remote communication technology: any means that can be used to conclude a contract without the consumer and entrepreneur being simultaneously present in the same space.
- Terms & Conditions: these Terms & Conditions of the entrepreneur.
Article 3 – Applicability
These Terms apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these Terms will be made available to the consumer. If this is not reasonably possible, the consumer will be informed where the Terms can be reviewed and that they will be sent free of charge upon request.
If the distance contract is concluded electronically, the Terms may be provided electronically in such a way that the consumer can easily store them on a durable data carrier.
If specific product or service conditions also apply, the consumer may always rely on the provision most favorable to them in the event of conflicting conditions.
If any part of these Terms is found to be void or invalid, the remaining provisions shall remain fully applicable. The invalid clause will be replaced by a clause that reflects the original intention as closely as possible.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be stated clearly.
The offer is non-binding. The entrepreneur is entitled to modify or adjust the offer.
All images and descriptions are indicative and cannot give rise to compensation or dissolution of the contract. Colors may vary slightly from actual product colors.
Each offer includes clear information regarding:
- The price
- Any shipping costs
- The method by which the agreement will be concluded
- Whether the right of withdrawal applies
- The payment, delivery, and execution processes
- The validity period of the offer
- Any other contractual details relevant to the consumer
Article 5 – The Agreement
The contract is established when the consumer accepts the offer and meets the associated conditions.
When the consumer accepts an offer electronically, the entrepreneur will promptly confirm receipt of the acceptance. Until this confirmation is received, the consumer may dissolve the contract.
If the agreement is formed electronically, appropriate security measures will be applied to ensure safe data transmission.
The entrepreneur may verify whether the consumer can meet payment obligations. If there are legitimate reasons, the entrepreneur may refuse or cancel the order.
With the order, the consumer will receive:
- The entrepreneur’s contact address for complaints
- Information regarding the right of withdrawal
- Information on warranties and after-sales service
- All details of the agreement as required by law
Article 6 – Right of Withdrawal
The consumer may dissolve a purchase within 14 days of receiving the product. During this period, the consumer must handle the product and packaging carefully.
To exercise the right of withdrawal, the consumer must notify the entrepreneur in writing within 14 days. The product must then be returned within 14 days after this notice.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, return shipping costs are at the consumer’s expense.
The entrepreneur will refund the purchase amount within 14 days, provided the returned product has been received or sufficient proof of return has been supplied.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for specific products, such as:
- Products made to the consumer’s specifications
- Hygiene products with broken seals
- Products that cannot be returned due to their nature
Article 9 – Pricing
Prices will not increase during the validity period of the offer unless required by law. Prices may vary if linked to external market factors.
All prices are subject to printing or typographical errors. In such cases, the entrepreneur is not obliged to deliver at the incorrect price.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that products comply with the contract and applicable legal standards.
Defects must be reported within 14 days of delivery. Returns must be in original packaging and condition.
Article 11 – Delivery and Execution
The entrepreneur will exercise the greatest possible care when processing orders.
Orders will be shipped within 30 days unless otherwise agreed. In case of delays, the consumer will be informed within 30 days.
The risk of damage or loss remains with the entrepreneur until delivery to the consumer.
Article 12 – Long-Term Transactions
Consumers may cancel long-term contracts at any time, respecting applicable notice periods.
Article 13 – Payment
Unless otherwise agreed, payments must be made within 7 days. The consumer must notify the entrepreneur of any incorrect payment details immediately.
Article 14 – Complaints
Complaints must be submitted within 7 days after defects are discovered.
The entrepreneur will respond within 14 days. If a complaint requires more time, the consumer will be informed.
Article 15 – Disputes
Only Dutch law applies to agreements covered by these Terms, even if the consumer lives abroad.
